These Terms & Conditions govern your access to and use of the Listara website, Free Evidence Check, SKU Readiness Pilot, waitlists, and any related services or communications provided by Listara.

By using the website or submitting information to Listara, you agree to these Terms.

If you enter into a separate written agreement with Listara, that agreement will prevail to the extent of any conflict.

Listara helps marketplace sellers, brands, importers, and agencies review SKU-level product compliance evidence readiness.

Listara provides evidence-readiness reviews only. Listara does not provide legal advice, certification, laboratory testing, notified-body services, official marketplace approval, or a guarantee that any marketplace, authority, retailer, or other third party will accept your documents or listings.

The Free Evidence Check is a limited diagnostic based on information you submit and information that may be visible from marketplace listings or product pages.

The Free Evidence Check may identify likely evidence gaps, unclear document categories, listing-signal issues, or suggested next steps.

It does not include:

• legal advice • certification • laboratory testing • full regulatory assessment • official marketplace approval • document submission to Amazon or another marketplace • guaranteed acceptance by any marketplace, authority, or retailer

The SKU Readiness Pilot is a paid or scoped review that may include a deeper analysis of multiple SKUs, ASINs, product files, supplier documents, certificates, test reports, SDS, declarations of conformity, screenshots, marketplace requests, or related evidence.

The exact scope, deliverables, timeline, price, and assumptions should be agreed separately in writing.

Unless expressly agreed, the SKU Readiness Pilot remains an evidence-readiness review and does not replace legal, technical, laboratory, notified-body, or regulatory advice.

The Evidence Control Tower may be presented as a future product or coming-soon feature. Joining a waitlist does not create a right to access the product, does not guarantee availability, and does not create a paid contract unless separately agreed.

You are responsible for:

• ensuring that information submitted to Listara is accurate and complete • ensuring that you have the right to submit documents, screenshots, product files, and data • reviewing all outputs before relying on them • making your own product, marketplace, legal, and compliance decisions • obtaining legal, regulatory, laboratory, technical, or certification advice where needed • submitting documents to marketplaces, authorities, or retailers where required

You retain ownership of the content, documents, product data, and files you submit to Listara.

You grant Listara the limited right to use submitted content to provide, operate, improve, secure, and support the requested service, including evidence-readiness workflows and related communication.

You must not submit content that infringes third-party rights, contains unlawful material, or includes sensitive personal data unless explicitly agreed.

Listara may use AI-assisted workflows, document parsing, classification, extraction, or automation to support service delivery.

AI-assisted outputs may contain errors or omissions. You are responsible for reviewing outputs and obtaining professional advice where required.

Unless separately agreed, Listara does not use submitted customer catalog data, documents, or product files to train public foundation models.

Listara outputs are informational and operational evidence-readiness outputs.

They are not legal advice, product certification, laboratory testing, safety assessment, notified-body review, official marketplace approval, or regulatory clearance.

No Listara output guarantees that a product, document, listing, label, warning, or submission is compliant or will be accepted by Amazon, another marketplace, a retailer, an authority, or any other third party.

References to Amazon, eBay, Etsy, Shopify, Otto, Kaufland, or other marketplaces, platforms, retailers, regulations, standards, or third parties are for descriptive purposes only.

Amazon is a trademark of Amazon.com, Inc. or its affiliates. Listara is not affiliated with or endorsed by Amazon.

Other names and trademarks belong to their respective owners.

Fees for paid services, including any SKU Readiness Pilot, will be agreed separately.

Unless otherwise agreed, fees are payable according to the invoice or checkout terms provided at the time of purchase or booking.

Where you provide non-public business, catalog, supplier, or product information, Listara will treat that information as confidential and use it only for the purposes of providing or supporting the service, unless otherwise agreed or required by law.

Listara processes personal data in accordance with the Privacy Policy. Where Listara processes personal data on behalf of a customer as a processor, the Data Processing Agreement may apply.

You must not misuse the website or services, including by:

• submitting unlawful, harmful, misleading, or infringing content • attempting to access systems without authorization • disrupting or interfering with the website or service • using Listara outputs to misrepresent certification, legal approval, or official marketplace approval • reverse engineering, scraping, or abusing the service except where permitted by law

The website and services may be modified, interrupted, or discontinued. We aim to provide a reliable service but do not guarantee uninterrupted availability unless separately agreed in writing.

To the maximum extent permitted by law, Listara provides the website, free checks, and related outputs on an “as is” and “as available” basis.

We do not warrant that outputs will be complete, error-free, legally sufficient, or accepted by third parties.

To the maximum extent permitted by law, Listara is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, lost profits, lost business, loss of data, product delisting, marketplace suspension, or rejected submissions.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

We may update these Terms from time to time. The latest version will be available on this page.

These Terms are governed by the laws of Germany, unless mandatory law provides otherwise.

The courts of Munich shall have jurisdiction where legally permissible.
